• “Product” means any digital or physical fitness or related product purchased through the ShqipFit LLC website or ShqipFit LLC Applications.

• “Software” means the ShqipFit LLC application that a user can use on a computer or supported mobile device in order to utilize the Services; the Software may be downloaded or accessed on the Internet. 

General Terms of Use 

• You must create an Account in order to use the Service. 

• You must be at least 16 years old to use the Service. 

• You must use the ShqipFit LLC website and Service only in accordance with our Acceptable Use Policy. 

• You are responsible for any activity that occurs through your account, and you agree not to sell, transfer, license, or assign your account, followers, username, or any account rights. Unless expressly authorized to create accounts on behalf of employers or clients, ShqipFit LLC prohibits the creation of accounts for anyone other than yourself. You also confirm that all information provided to ShqipFit LLC during registration and at all other times is true, accurate, current, and complete. You agree to update your information as necessary to ensure its continued truth and accuracy. 

• You agree not to solicit, collect, or use the login credentials of other ShqipFit LLC users. 

• You are responsible for keeping your password secret and secure. 

• You must not defame, stalk, bully, abuse, harass, threaten, impersonate, or intimidate individuals or entities. Additionally, you must refrain from posting private or confidential information via the Service. Violation of these rules will result in the deletion of your account, and we will report you to the relevant authorities. 

• You may not use the Service for any illegal or unauthorized purposes. 

• You are solely responsible for your conduct and the content that you submit, post, or display on or via the Service. 

• You must not change, modify, adapt, or alter the Service. Also, you must not change, modify, or alter another website to falsely imply association with the Service or ShqipFit LLC. 

• You must not create or submit unwanted emails, comments, likes, or other forms of commercial or harassing communications (commonly known as “spam”) to any ShqipFit LLC users. 

Rights & Ownership 

• ShqipFit LLC does not claim ownership of any content that you post on or through the service. Instead, you hereby grant ShqipFit LLC a non-exclusive, fully paid, royalty-free, transferable, sub-licensable, worldwide license to use the content you post on or through the service, subject to our Privacy Policy. 

• You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such. 

• You represent and warrant that: (i) you own the content posted by you on or through the service or otherwise have the right to grant the rights and licenses set forth in these Terms and Conditions; (ii) the posting and use of your content on or through the service do not violate, misappropriate, or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademarks, and/or other intellectual property rights; (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of content you post on or through the service; and (iv) you have the legal right and capacity to enter into these Terms and Conditions in your jurisdiction. 

• The service contains content owned or licensed by ShqipFit LLC (“ShqipFit LLC Content”). ShqipFit LLC Content is protected by copyright, trademark, patent, trade secret, and other laws, and, as between you and ShqipFit LLC, ShqipFit LLC owns and retains all rights in the ShqipFit LLC Content and the service. You will not remove, alter, or conceal any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the ShqipFit LLC Content, and you will not reproduce, modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license, or otherwise exploit the ShqipFit LLC Content.We recommend buying your favorite toothbrush at super low prices with free shipping, and you can also pick up your order at the store on the same day. 

• The ShqipFit LLC name and logo are trademarks of ShqipFit LLC and may not be copied, imitated, or used, in whole or in part, without the prior written permission of ShqipFit LLC. In addition, all page headers, custom graphics, button icons, and scripts are service marks, trademarks, and/or trade dress of ShqipFit LLC and may not be copied, imitated, or used, in whole or in part, without the prior written permission from ShqipFit LLC. 

• You agree that ShqipFit LLC is not responsible for and does not endorse nor monitor any third-party content posted within the service. ShqipFit LLC does not have any obligation to pre-screen, monitor, edit, or remove any third-party content. If your content violates these Terms and Conditions, you may bear legal responsibility for that content. 

App Payments 

All app subscription payments are handled through the Apple and Google app stores and are under their terms and conditions.  

There are three types of auto renewal subscriptions for each trainer.  
 

– Monthly (1 month) Auto renewal subscription for each trainer: 

• Title of Auto-Renewing Subscription: Monthly Subscriptions / or / 1 Month Subscription 

• Length of Subscription: 1 Month 

• Price of Subscription: 9.99 eur 

• Price Per Unit (if applicable): not applicable 

– Quarterly (3 months) Auto renewal subscription for each trainer: 

• Title of Auto-Renewing Subscription: Quarterly Subscriptions / or / 3 Months Subscription 

• Length of Subscription: 3 Months 

• Price of Subscription: 19.99 eur 

• Price Per Unit (if applicable): not applicable 

– Yearly (12 months) Auto renewal subscription for each trainer:  

• Title of Auto-Renewing Subscription: Yearly Subscriptions / or / 1 Year Subscription / or / 12 Months Subscription 

• Length of Subscription: 12 Months 

• Price of Subscription: 49.99 eur 

• Price Per Unit (if applicable): not applicable 

If you subscribe to one fitness trainer you will have access to all the fitness plans to the subscribed fitness trainer, you will not have access to another fitness trainer plans. You will have to subscribe to each fitness trainer that you would like to access their fitness plans. 

PLEASE NOTE: Depending on which country you’re in VAT will be added to the price, according to Apple & Android legislation. 

Subscription Info 

The ShqipFit app can be downloaded free of charge. However, upon registration, users will need to subscribe to gain access to the app’s content. Our subscription services operate on a renewal basis, depending on the subscription package chosen – Yearly, Quarterly, or Monthly. It’s important to note that after twelve months, the renewal costs for your selected subscription will not include any discounts that may have been applied to the initial purchase. The renewal will be at the current subscription cost, excluding any discounts. 

For users paying in currencies other than the default, rates are determined directly by Apple or Google.  

Subscribing will give you access to all features the app offers. But limited access to only the fitness trainers plans you have subscribed to. 

• If you decide to subscribe, you agree to instantly pay the price shown upon confirmation of purchase. 

• Payment will be charged to the payment account linked to the card to Apple or Google account connected to your device. 

• If it is not cancelled earlier on, a subscription will automatically renew within 24 hours before the end of the current subscription period. 

• Your account will be charged for renewal within 24 hours before the end of the current subscription period. 

• You have the right to manage your subscription and auto-renewal may be turned off at any point after purchase. 

• The amount you paid for your subscription upon purchase is non-refundable even if the subscription is terminated or cancelled early.

If you use or rely on any information in the app, you are responsible for independently verifying its accuracy, completeness, reliability, and relevance to your personal and individual circumstances.

Refund Policy 

As ShqipFit LLC is a digital product, upon subscription, you gain access to all the content available on the app and only access to the fitness trainers plans you have subscribed to. Therefore, you hereby acknowledge that your purchase cannot be cancelled, and the Seller is not obliged to provide a refund. 

Refunds for the Product shall only be given under exceptional circumstances: 

• If there is a technical issue for which the Seller is responsible, preventing you from accessing the Product. 

• In the case of a duplicate subscription payment due to a technical fault. Genuine multiple orders by the same person are not eligible for a refund. 

• If your subscription payment was not a genuine transaction (e.g., card fraud, etc.). 

Change of Mind & Early Termination: 

Even in the event of an accidental purchase, a change of mind, or the realization that there are legitimate reasons why the Product is not suitable for you, we will not be able to provide a refund. Terminating your subscription early does not entitle you to a refund of any unused portion of your subscription, even if you stop accessing the app before the subscription expiration date. 

Technical Issues: 

The Product may be prone to technical issues related to your device, operating software, or other installed applications that can interfere with the Product’s performance. Issues of this nature are not necessarily the result of oversight during the Product’s development and may often be beyond the Seller’s control. Nonetheless, the Seller should always strive to rectify these issues promptly to ensure the Product’s optimum performance for all customers. If the Seller is actively working to resolve these technical issues, and they do not significantly impact the overall usage of the Product, experiencing them will not constitute grounds for a refund.

FAULTY PRODUCTS  

If you have received a defective product, please submit a picture of the faulty item within 60 days (about 2 months) of purchase. We can arrange for an exchange; however, please note that refunds are not available.
